Frequently asked legal questions

Who publishes MerchantHQ?

The MerchantHQ application is published and operated under the legal responsibility of Mrs. Paulette Sankinka, acting as the legal representative on behalf of the project created and developed by Enzo Izinga. The application and website are hosted by Vercel Inc., and the database is hosted by Turso (ChiselStrike, Inc.).

What data does MerchantHQ collect?

We collect: manager/user identity (full name, email address, WhatsApp phone number), store/business information (store name, business sector, location — city, district, country), and usage data (subscription history, sale transactions, and checkout system records).

What does "sharing my details with partners" (Opt-in) mean?

This is an optional consent, separate from the email subscription. From the application settings, you may agree that your professional contact details (Name, Phone Number, Business Sector, City) be shared with MerchantHQ commercial partners (wholesalers, financial services) to receive offers suited to your shop. If you enable it, these contacts may be transmitted or monetized with vetted third parties. If you do not, your details remain strictly confidential and restricted to internal MerchantHQ usage. The email subscription offered at registration is a separate consent.

How can I withdraw my consent to data sharing?

You may withdraw your consent at any time through application settings or by contacting technical support. Upon receiving an opt-out request, your information will be excluded from future partner data exports.

Are my data and password secure?

Yes. Data is encrypted and securely stored in cloud databases hosted by Turso, managed via secure APIs on Vercel. No plain-text passwords or financial transaction secrets are stored in clear text.

How do the Starter, Business and Big plans work?

MerchantHQ offers several paid or trial subscription options: the Starter Plan (core functionality designed for small retail stores), the Business Plan (for growing businesses managing multiple stores or inventory lines), and the Big Plan (full-featured suite for retail networks and high transaction volumes). Access to paid features requires prior payment of subscription fees according to current pricing schedules.

What happens if I don't pay my subscription?

The publisher reserves the right to adjust rates or suspend access in the event of non-payment, in accordance with the terms of service and conditions of sale.

Can I use MerchantHQ offline?

Yes. MerchantHQ is designed to work offline: point-of-sale, inventory, clients and appointments remain usable without a connection. Cloud backups are sent as soon as a connection is restored, subject to network availability.

Which law applies in case of a dispute?

These Terms of Use shall be governed by and construed in accordance with the laws of the Democratic Republic of the Congo, including the Digital Code (Code du Numérique — Ordonnance-loi n° 23/010), as well as applicable international digital trade regulations.

What happens if I use the service fraudulently?

MerchantHQ reserves the right to terminate or suspend user access immediately without prior notice in the event of a violation of these Terms of Use or fraudulent activity. In particular, users must not attempt to extract the source code, decompile the application, or compromise the security or integrity of the database and servers.
